Overview

Margaret practices in the areas of labor and employment law, business litigation, and education law. She is certified by the Ohio State Bar Association as a specialist in employment and labor law. She has tried cases in both state and federal courts and before state and federal administrative agencies and has argued appeals in state and federal courts, including the Ohio Supreme Court. Margaret also handles labor negotiations, labor and commercial arbitrations, policy and handbook reviews, workplace investigations, teacher termination proceedings, and supervisor training for private and public sector employers. Margaret lectures frequently on labor and employment and education law topics.

Margaret served for ten years as a judge pro tem of the Perrysburg Municipal Court. Margaret served as law clerk to the Hon. Robert E. DeMascio, U.S. District Court for the Eastern District of Michigan from 1986-88. She joined Marshall Melhorn in 2014, after practicing with a Toledo litigation firm for more than twenty-five years.

Representative Matters

  • Obtained defense verdicts and affirmance on appeal for Fortune 500 companies in federal and state race discrimination, sex discrimination, retaliation, and sexual harassment cases.
  • Secured summary judgment for large and small public and private employers in discrimination and retaliation cases under Title VII, ADA, FMLA, and state law.
  • Successfully defended administrative claims before Ohio and Michigan fair employment agencies, EEOC, OSHA, DOL, OFCCP, NLRB, and SERB.
  • Successfully represented national healthcare employer in U.S. Court of Appeals and U.S. Supreme Court in case where U. S. Supreme Court rejected NLRB’s long-standing definition of supervisory status in health care facilities.
  • Secured preliminary injunctive relief and negotiated resolution of non-compete claims on behalf of employers
  • Successfully defended pension plan administrators against ERISA claims.
  • Negotiated private and public sector collective bargaining agreements
  • Secured summary judgment on threshold legal issues leading to beneficial
  • settlements for policyholders in insurance coverage litigation.
