Marshall Bennett is a seasoned trial lawyer, arbitrator, and mediator. He has a diverse civil trial practice involving complex business, commercial, and employment disputes. He also has extensive experience as an arbitrator, mediator, and early neutral evaluator in cases involving business, commercial, and employment disputes.
Marshall’s experience as a civil trial lawyer includes disputes between auto industry suppliers, disputes involving hospitals, health care systems, and physician employment, patent and trademark infringement claims, anti-trust disputes, trade secret, non-competition, and unfair competition disputes, insurance coverage disputes, breach of warranty claims, attorney malpractice claims, and attorney professional discipline.
Marshall’s ongoing studies include an intense focus on legal technology, eDiscovery tools, and trial presentation technology, and how they can be used to represent clients more effectively. He is the Chair of the Toledo Bar Association’s Technology Committee, and frequently speaks on legal technology, eDiscovery, and trial presentation issues for local courts and the Toledo Bar Association.
Marshall is on the American Arbitration Association’s Commercial, Labor/Employment, and eDiscovery Arbitrator Panels and its Mediator Panel. He regularly attends American Arbitration Association arbitrator and mediator training programs, and recently completed its 32-hour mediator training program. Marshall is also a member of the Panel of Neutrals of the United States District Court for the Northern District of Ohio and is the Chair of the Subcommittee of that Court’s Attorney Advisory Group responsible for the Court’s ADR program.
Marshall experience as an arbitrator includes disputes involving employment agreements and professional services contracts, employment discrimination and sexual harassment claims, health care disputes including disputes involving physician employment contracts, business sales disputes, and disputes between manufacturers and independent representatives. Marshall has served as a mediator and early neutral evaluator in cases involving employment, patent infringement, and other claims pending before the United States District Court for the Northern District of Ohio.
Marshall is the Chair of Marshall & Melhorn’s Litigation Group and serves as the firm’s Ethics and Professional Practices Counsel.
