Overview

John Borell is a member of the firm’s Litigation group and focuses on business and commercial litigation, creditor’s rights, and fiduciary/estate litigation.

In his business and commercial litigation practice, John represents small and medium sized businesses in a variety of disputes including contract actions, unfair competition, and employment agreements. He understands that for many clients, litigation is not seen as simply a “cost of doing business” and has experience in helping those clients find solutions to their business disputes. He also acts as local counsel for businesses outside this region that find themselves in disputes in state or federal court in Northwest Ohio or Southeast Michigan.

In his creditor’s rights practice, John represents regional and community lenders in enforcing secured and unsecured commercial loan agreements. He has experience in business and real estate receiverships and multiple asset real estate collateral disputes. John has experience in assisting creditors in actions for cognovits judgments, pre-judgment attachment, replevin, foreclosures, and other pre and post-judgment remedies. More important, he works with creditors to find cost-effective solutions to enforcing their rights against borrowers.

In his fiduciary and estate litigation practice, John has represented executors, trustees, guardians, and other fiduciaries in claims brought by beneficiaries, and beneficiaries in protecting and asserting their rights under testamentary documents. John understands fiduciary litigation can be emotionally difficult, often involving family members at odds with one another, and works regularly with members of the firm’s Trust and Estates group in pre-litigation planning to avoid disputes, and alternative dispute resolution to find common ground among those family members when possible.

Finally, John has an interest in trademark law and assists a Fortune 500 company in protecting its trademarks both nationally and globally. This has included UDRP (Uniform Domain-Name Resolution Policy) and URS (Uniform Rapid Suspension System) actions, appearing before the Trademark Trial and Appeal Board, and coordinating representation of local agents in international trademark infringement and registration disputes.

To John, the best aspect of practicing law is getting to know his clients, particularly business owners, and helping them resolve their commercial disputes so they can focus on what is most enjoyable to them—running and growing their businesses.

Representative Matters

  • Successfully defended two class action suits against owners of manufactured home parks in lawsuits brought by tenants.
  • Successfully made a claim with the Securities Investor Protection Corporation (SIPC) fund where a broker engaged in a multi-year fraud scheme.
  • Represented an industrial nondestructive testing company in a multi-million dollar lawsuit over allegedly defective welds at an oil and gas refinery.
  • Represented the supplier of bridge components in a multi-million dollar lawsuit where the Ohio Department of Transportation alleged the components were defective.
  • Represented the beneficiaries of a trust in an action where they recover funds misappropriated by a lawyer/trustee.
  • Represented employees and employers in preliminary injunction proceedings involving alleged violations of non-compete agreements.
  • Represented a regional bank in a number of multiple asset real estate collateral disputes and in seeking receivers to enforce loan documents and liquidate businesses.
  • Acted as local counsel for a national marketing communications company in employment litigation and for a national automotive company that company provides wholesale financing in a contract dispute with a regional dealer.
  • Represented a worldwide automotive supplier in a multi-county trademark registration dispute.
